Terms & Conditions

These Terms & Conditions ("Terms") govern your use of EExtend (www.eextend.net), an AI services suite for ecommerce stores operated by FME Modules, 1203, 701 Tillery Street, Unit 12, Austin, TX 78702, United States ("we", "us", "our"). By creating an account or using EExtend, you agree to these Terms.

1. The service

EExtend provides AI-powered services for ecommerce stores, including an AI chatbot, AI translation, and AI content generation, delivered through connector modules installed on your store platform. A single subscription includes access to all services in the suite; new services we add may be included at our discretion.

2. Accounts

• You must be at least 18 years old and use EExtend for business purposes.
• You are responsible for the accuracy of your account information and for keeping your credentials secure.
• You are responsible for all activity under your account, including team members you invite.

3. Subscriptions, trials & billing

• Free trial. New accounts receive a 7-day free trial. No credit card is required; the trial does not auto-convert to a paid plan.
• Billing. Plans are billed monthly in advance via Stripe.
• AI credits. Each plan includes a monthly credit allowance. Unused credits do not roll over. If you exhaust your credits, AI services pause until the next cycle or an upgrade.
• Plan changes. Upgrades take effect immediately with prorated billing; downgrades take effect at the next billing cycle.
• Cancellation. You may cancel anytime from your dashboard; access continues until the end of the paid period. Fees already paid are non-refundable except where required by law.
• Price changes. We may change prices with at least 30 days' notice; changes apply from your next billing cycle.

4. Acceptable use

You agree not to:

• Use the services for unlawful, harmful, or deceptive content or activity
• Generate content that infringes third-party rights or violates applicable law
• Attempt to reverse-engineer, resell, or provide the services to third parties outside your stores
• Circumvent credit limits, security measures, or usage restrictions
• Use the services to build a competing product

5. AI-generated content

You own the content generated for your store through EExtend, to the extent permitted by law. AI output may contain inaccuracies; you are responsible for reviewing content (including translations, product copy, and chatbot responses) before relying on it commercially. AI processing is provided through third-party model providers (OpenAI, Google Gemini, Mistral) as described in our Privacy Policy.

6. Your data

You retain all rights to your store data. You grant us a limited license to process it solely to provide the services. Data handling, retention (30 days after subscription ends), and GDPR rights are described in our Privacy Policy.

7. Intellectual property

EExtend, including its software, connector modules, design, and branding, is owned by FME Modules and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the services during your subscription.

8. Availability & support

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance and factors outside our control (including third-party AI provider outages) may affect availability. Support is provided according to your plan tier.

9. Disclaimer of warranties

The services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI output will be accurate, complete, or error-free.

10. Limitation of liability

To the maximum extent permitted by law, FME Modules will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of these Terms is limited to the amounts you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account for material breach of these Terms, including non-payment or prohibited use, with notice where practicable. Upon termination, your data is deleted within 30 days as described in the Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or in your dashboard at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Courts located in Travis County, Texas have exclusive jurisdiction, except where mandatory consumer law provides otherwise.
